ILC’s Draft Articles
The International Law Commission is, as we will see next week, the body responsible for the codification of international law. Article 2 of the ILC’s Draft Articles on the Responsibility of International Organizations states that:
"For the purposes of the present draft articles, the term 'international organization' means an organization established by a treaty or other instrument governed by international law and possessing its own international legal personality. International organizations may include as members, in addition to States, other entities".
If the International Law Commission' definition of international organizations refers to their legal personality, it is because this is one of the most important features of international organizations and that there is no responsibility without legal personality. ...Less
